Terms of Service

1. Purpose of the service

marge.studio is a SaaS (Software as a Service) tool that enables digital agencies and independents to:

• Simulate the profitability of their quotes before signing.
• Track the budget progress of their projects in real time.
• Analyse their overall and per-project margin.
• Receive personalised recommendations to improve their profitability.

2. Access to the service

Beta period: access to the service is currently free during the beta phase. The publisher reserves the right to introduce pricing at any time, with at least 30 days' notice by email.

The service is accessible via a modern web browser (Chrome, Firefox, Safari, Edge). The publisher does not guarantee availability on outdated browsers.

The service is provided in beta, with no uptime commitment (SLA). Interruptions may occur for maintenance, deployment, or technical incident reasons. The publisher commits to restoring the service as quickly as possible in the event of an outage.

3. Account creation

Using the service requires creating an account with a valid email address. You are responsible for the confidentiality of your credentials and all actions taken from your account.

One account per person or entity. Shared accounts between multiple people are only permitted within the context of an agency you are responsible for.

4. User obligations

By using marge.studio, you agree to:

• Provide accurate information when registering and using the service.
• Not attempt to access other users' data.
• Not use the service for illegal or immoral purposes.
• Not intentionally overload the servers (DDoS attacks, mass scraping).
• Not reproduce, resell, or commercially exploit the service without prior written authorisation.

5. Intellectual property

The entire marge.studio service — interface, source code, algorithms, brand, logotype, editorial content — is the exclusive property of its publisher, a French sole trader currently being registered, and is protected by French intellectual property law.

Your data belongs to you. The data you enter into the service (quotes, projects, clients, etc.) remains your exclusive property. marge.studio claims no rights over this data.

6. Limitation of liability

marge.studio is a decision-support tool. The margin calculations, projections, and recommendations produced by the service are provided for informational purposes only and do not constitute financial, accounting, or legal advice.

The publisher cannot be held liable for financial losses resulting from decisions made on the basis of data displayed by the service. The publisher's liability is limited, in all cases, to the amounts paid by the user in the preceding 12 months.

The publisher cannot be held liable for a service interruption due to force majeure, infrastructure provider failure (Vercel, Supabase), or cyberattacks.

7. Termination

At your initiative: you may delete your account at any time from the application settings or by contacting contact@marge.studio. Deletion results in the permanent erasure of all your data within 30 days.

At the publisher's initiative: the publisher reserves the right to suspend or delete an account in the event of a breach of these ToS, with prior notice by email except in cases of emergency (security, fraud).

8. Changes to the Terms

The publisher may modify these Terms at any time. Users will be notified by email at least 15 days before the new terms take effect. Continued use of the service after that period constitutes acceptance of the new Terms.

9. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before resorting to legal proceedings.

Failing that, the dispute shall be submitted to the competent French courts, notwithstanding multiple defendants or warranty claims.
